Sky Deck Streams Service Agreement
Congratulations and welcome to the Sky Deck Streams streaming artist community. This email is the legal contract between you and JVonD Productions (LLC) and by replying to this email and/or submitting payment to sales@jvond.com means that you agree to the terms listed below.

Service Period
This is an on going monthly contract that will continue until you or JVonD Productions terminates the agreement at the end of a payment period (monthly) by using email or by not paying in full by the 1st of the month. You will receive 5 days of free streaming service as a trial period (party stream users not included). JVonD Productions reserves the right to refuse payment and terminate the contract at anytime.

Payments
First setup is free! By entering into the service contract in the middle of a payment period, the total for that month will be pro-rated by a 30 day division of the monthly cost. Any fractioned denominator will be rounded to the next cent to the customers favor. Payments shall be made to the sales@jvond.com paypal account by the beginning of the following month's service. If the payment was not received by the first of the month the account will be inactive and there will be a $5 charge to restart the service. The pricing is subject to change at anytime starting on the following payment period. Please send check or money orders to JVonD Productions.

Packages
All streams come with a web page (player page) that has a basic Flash Media stream player along with the streams access URL for people with incompatible browsers. Included is playlist service so that users can upload mp3 files via FTP to a directory and then have the server play them from its remote location. The mp3 files can be uploaded at any bitrate but stream will be limited to your specified rate. Recommended 128 kbps or below will get you lots of play time considering you storage space is limited. This service includes a Web page that you can edit and also a platform on the Sky Deck in Second Life. Do not edit any files in the "playlistloader" folder or you may be be charged for a service repair and restart if your stream errors. Also be sure not to edit files in the playlist folder that are current streaming because that will cause the stream to error and you will be charged for a restart. Monthly Premium Streams come with;
- 500 megabyte FTP account that includes the default home page mentioned above (editable) and is accessed through a subdomain within the corresponding server.
- Sky Deck Club for hosting live events.
- Sky Deck platform in Second Life for 24/7 stereo streams. (your Second Life host – JVonD Television)
- LIVE OPTION add $5 per month. This option gives you an access port to seamlessly break live into the stream.
- LIVE ARCHIVING add $3 per month. This option will record your "LIVE" event and save it to your archives folder.
- EXTRA STORAGE add $1/200Mb per month.
- EXTRA STORAGE add $2/500Mb per month.

3X Uptime Guarantee
The Sky Deck Servers are only the best in enterprise level networking technology and we guarantee our service, but no servers are 100% reliable and that's why you should make sure you use an application that can reconnect quickly if the server fails. If and when it fails it should quickly automatically restart and your stream should connect with little down time. If you notice the server fail you will need to take action to get your refund by simply emailing jvondproductions@yahoo.com . Depending on date and time of the email effects the amount of refund you will receive. If you are in the middle of an important show and need immediate assistance please call JVonD @ xxx-xxx- xxxx . From the time of the email to the time the server is back up and running will be your refund period. The total time will be rounded to the next hour in your favor. Take your refund period and multiply that by 3 and then subtract from 720 (hours in a 30 day period). From there your fallowing month's payment will be pro-rated so that you receive the cost back for the drop time X3. This guarantee is limited to the full cost of your payment period.

Example: If your stream is down for 3 hours, then the following pay period you will get 9 free hours which is deducted from that month's payment.

There may be instances where your stream fails but it is not the servers fault. You should test your computers and programs to weed out any bottlenecks that might interfear the flow of data to the server. If you notice the server down please check your stream page. If that link is down then you know the server is having problems and you should immediately email- jvondproductions@yahoo.com and then the guarantee will be calculated from that time.and then the guarantee will be calculated from that time.

Money Back Guarantee
I'm so confident that you'll enjoy your time with the Sky Deck community that I will even pro-rate your money back to you for the remainder of that payment period if you are not entirely satisfied. But if you choose this option and what to join the community again it will be a $30 setup fee.

Sky Deck Streaming Platforms and Website
The streaming platforms are an added bonus to your streaming service and are optional. By no means do you have any control over anything that happens within the Sky Deck's Second Life areas or website. Your suggestions are welcome and we would like to help you in anyway possible but there are certain limitations and designs that everyone participating must conform to. Everything done on the website and in Second Life is entirely up to JVonD Productions and we reserve the right to do what ever we like in those realms. The areas in Second Life will change considerably over time and each stream is unique so as the Sky Deck grows you will be placed on platforms for your closest genre category. Sky Deck platforms are reserved for stereo streams that run 24/7 nonstop with bit rates of 80 to 128 kbps.

Nuisance Warnings
If you are a nuisance to the Sky Deck community you will be warned once via email. If this nuisance occurs again JVonD Productions has the right to terminate your service and not return any remaining funds.

Referrals
If you refer a new client to Sky Deck Streams please have them add your name to the request of service and based upon which premium package they sign up for your monthly charge will be discounted for how ever long they are a part of the service. Your discount will be calculated by the amount of listeners the new account has until the service is terminated and you are able to have as many referrals until your monthly cost is 0$. Here's how it calculates.

100 listeners = 8$ off of your monthly rate
60 listeners = 6$ off of your monthly rate
40 listeners = 4$ off of your monthly rate
20 listeners = 2$ off of your monthly rate

Party Stream
This stream is available to the Public for free as long as the user schedules a time in advance with JVonD and requires that the stream host emails jvondproductions@yahoo.com with start and end times after every event. By using the party stream you will give up your 5 day free trial using your own account.

Other Services And Charges
$10.00 to change any account/stream information after the first setup.
$20.00 to rebuild your account after you have deactivated it.
$20.00 to repair your service if you cause an error by running a playlist and then removing the mp3 files causing a crash.

Considerations
Check your bandwidth speed at an online service and adjust your streaming bandwidth along with your FTP speeds accordingly for no skip streaming. Also having a solid new high speed router helps for networks.
Not only does conferencing software,uploading, and Second Life tax your bandwidth it can push your computer to its processing limits. Skipping sometimes occurs from your computers hardware getting over used and not your bandwidth.
Use a shoutcast application that will reconnect if the connection is lost. Set your local computer to have a longer gap between reconnecting than your remote computer.
In order to use the club for live events please check with JVonD Television a week in advance for calendar info.
Shoutcast streams are very versatile meaning that you will have lots of control through plugins and added features (Examples – MP3 tag decoding, crossfade output effects, online yellow pages, public/private streaming) so don't forget to check your settings.

By agreeing to this contract you take the responsibility for any copyright violations on your stream or FTP and release JVonD Productions and Sky Deck Streams from penalties that you may incur.
